If you have been in an accident, it is important to keep in mind that you have legal rights that should be protected. There are time limits for pursuing different kinds of personal injury cases. At the very least, you should speak with an attorney as soon as possible following an accident to make sure your rights are protected. You should always talk to a lawyer before talking with an insurance representative if you have been seriously injured in an automobile accident or in any accident resulting in an injury that you believe was caused by another person or a faulty product. You should also talk to a lawyer if any of the following apply:

  1. You are being treated by a health care provider for injuries you sustained in the accident;
  2. The insurance company is claiming you were not injured as a result of the accident;
  3. The insurance company is claiming your treatment is or was unnecessary;
  4. The insurance adjustor is pressuring you to settle your claim before you have completed your treatment;
  5. You have a serious medical condition that was made worse as a result of the accident; or
  6. The insurance company has asked you to attend an “independent medical examination.”

If you are involved in an accident involving a motor vehicle, you should:

  1. Exchange information with the driver(s) of the other vehicle(s);
  2. Call the police. It is important to have the accident documented;
  3. Take photographs of the scene and of your vehicle;
  4. Be polite;
  5. Never discuss fault; and
  6. Seek medical treatment.

In all personal injury cases, where you are not solely at fault, you are entitled to recover damages for past, present and future medical bills, costs of prescriptions, wage loss, loss of earning potential and any other out-of-pocket expenses that were a result of the injury. You may also be able to recover damages for pain and suffering, emotional distress, scarring, loss of opportunity to enjoy life, wrongful death, loss of services, dismemberment, scaring, interference with the husband/wife or parent/child relationships, and any other type of general damage relating to injury.
